Impact Fee Program

Kane County’s Impact Fee Program operates i​n accordance with the Road Improvement Impact Fee Law of the State of Illinois (605ILCS 5/5-901 to et. seq.). The County’s Comprehensive Road Improvement Plan (CRIP)​​ document includes an assessment of the roadway network, quantifies the anticipated new development upon which estimated improvements are based, identifies available funding sources, anticipated highway improvements and estimated costs. The CRIP and Impact Fee Ordinance regulate the administration of the program, the assessment and collection of fees and the suite of available discounts.

Impact Fee Estimator Tool

​Developers and builders may now use the Impact Fee Estimator Tool to estimate the cost of impact fees.  The file below will open in Excel and users should read the Instructions sheet before using the tool.  This tool is an estimate only; the actual impact fee is calculated by the KDOT Impact Fee Coordinator upon submittal of an Impact Fee Application and other required documents.

Fee Assessment and Discounts

Fees for new development throughout Kane County are based upon the proposed use of the property and the associated trip generation for individual land uses contained on the property. The fee is calculated by staff based upon materials submitted by the developer.  The Ordinance provides for the methodology used to calculate fees and also provides for various ways to reduce the fee due.  Please reference the Ordinance​ 22-27​​, Sections 8, 9, and 10 ​for more information about potential reduction in fees due.

A new assessment tool, the Simplified Individual Assessment​ is now available for instances where the impact fee does not reflect the unique impact of the new development.  The Simplified Individual Assessment allows the use of any of the land use codes available in the Institute for Traffic Engineers (ITE) Trip Generation Manual.  More information is found in the Procedure Manual​ and the Assessment may be initiated after a discussion with the KDOT Impact Fee Coordinator.​​​


2022 Impact Fee Program Update

 The Kane County Board approved an updated CRIP and Impact Fee ordinance and fee schedule on January 11, 2022. Approved copies of the Comprehensive Road Improvement Plan (CRIP) document and Ordinance 22​-27-Impact Fees can be viewed by clicking the 2022-2027 CRIP, Ordinance and Fee Schedule link below. Documentation related to the update, including the Impact Fee Advisory Committee meetings and public hearings, is posted below.
