The Americans with Disabilities Act (ADA) was signed into law on July 26, 1990, by President George H.W. Bush. The Act is a civil rights statute that prohibits discrimination against people who have disabilities. There are five separate Titles of the Act that relate to potential discrimination. Title II of the Act specifically addresses the topic of making sure public services and public transportation are accessible to those with disabilities. The Act applies to all public facilities built before and after the arrival of the Act.

As a necessary step to provide accessibility under the Act, Kane County Division of Transportation is required to perform a self-evaluation of the current facilities relative to the accessibility requirements of the Act. Kane County DOT is then required to develop an ADA Transition Plan to address any deficiencies in their public facilities. As facilities are updated to current ADA standards, the Plan is required to be updated periodically until all barriers are removed. The Plan is intended to achieve the following:

• Identity physical obstacles that limit the accessibility of facilities to individuals with disabilities
• Describe the methods to be used to make the facilities accessible
• Provide a schedule for making the access modifications
  
• Identify the public officials responsible for implementation of the Transition Plan
• Establish a Grievance Procedure

The Planning and Programming Department is responsible for long-range transportation planning for the County roadway network and enhanced coordination of the  transit and bicycle / pedestrian ​systems. Staff works closely with the Kane County Development Department to integrate transportation and land use planning. The Department also monitors projects identified through the planning process for construction to ensure adequate funds are secured and the requirements of the Federal and State processes are met in a timely fashion. The D​epartment coordinates frequently with the Illinois Department of Transportation (IDOT), the Chicago Metropolitan Agency for Planning (CMAP), the Regional Transportation Authority (RTA) and other regional transportation agencies. The Department also provides staff for the Kane Kendall Council of Mayors.

The Kane County Division of Transportation also prepares a budget and Draft 5-year Transportation Improvement Program (TIP) annually. Information about the TIP can be found under Finance and Budget.

Impact Fee Program

Kane County’s Impact Fee Program operates i​n accordance with the Road Improvement Impact Fee Law of the State of Illinois (605ILCS 5/5-901 to et. seq.). The County’s Comprehensive Road Improvement Program (found below) includes an assessment of the roadway network, quantifies the anticipated new development upon which estimated improvements are based, identifies available funding sources, anticipated highway improvements and estimated costs. The CRIP and Impact Fee Ordinance regulate the administration of the program, the assessment and collection of fees and the suite of available discounts.​

Impact Fee Estimator Tool
